Omg how cool its out already! I've yet to listen, but I'm really looking forward to this episode, even though I'm predicting it won't be the most light hearted one out there.

Melissa said something in this PotterCast that I found to be particularly interesting. She commented that if JK Rowling said, you know, Melissa, I really don’t like commentary x in your book, please remove it, she would fight Jo on that point. This is not, she hastened to add, what is happening in Steve’s case. John said he had no sympathy for Steve because Steve had needlessly gone against Jo’s wishes and he was in the wrong. (I’m paraphrasing, obviously, so forgive my lack of quotes. ;))
All of that makes sense. If you thought JKR was legally in the wrong, you would fight her on it. Because in this case you obviously think she is in the right, you would not fight her and have no sympathy for Steve, because he is in the wrong. Thing is, Steve obviously disagrees with you. This is why I have sympathy for him, John. Because he clearly believes that JK Rowling is unfairly attempting to stop publication of his book, and that upsets him, just as Melissa would be upset if JK Rowling unfairly attempted to stop the publication of her book. Just because you disagree with him on that point does not mean that he is necessarily wrong. When so many legal experts – and I don’t think any of you fall into that category – have sided on RDR Books’ side, it seems sort of silly to me for you all to say, well, he’s wrong, and therefore I have no sympathy. I want to say a big thank you to all of the PotterCasters for this episode. The trial is clearly a divisive and emotional issue, and you all discussed it extremely eloquently and informatively. I was gripped the entire time, and agreed with all of your comments. I felt most of the time that you were expressing my thoughts in a much more articulate manner than I could, so thank you.

Elizabeth, the difference you haven't noted is that we're not syaing, "Because we agree with Jo": We're saying "because Jo is not disputing our right to have whatever opinion under the sun we want." If Jo's basis for arguing with my book was that she didn't want me to make commentary, we'd have a sincere disagreement. (I never worry about that because I am absolutely certain Jo believes in an individual's right to make commentary.) That is absolutely 100 percent not what is happening in the Lexicon case.
And what John said (a few times, I believe) was specifically NOT that he doesn't agree with Steve and therefore Steve gets no sympathy (that'd be a very silly argument, I agree, which is why it wasn't made); he said he felt no sympathy for him feeling ostracized from fandom, because he feels it was only his actions that did the ostracizing. That's a huge difference that I, and I'm sure many others, would appreciate being brought into the discussion. It's certainly an opinion John has the right to have: That Steve has made his bed and he didn't feel the reason that Steve was upset on the stand (that he doesn't feel part of the community) merited particular sympathy. As for the legal experts that have sided with RDR/SVA: Well, the ones from FUP have a clear higher agenda, and almost all the others (at least the ones I've read though I'm fairly sure I've read them all) have either shown or admitted non-familiarity with all elements of the case. I had an excellent discussion with Tim Wu the other day for a New Yorker article, that I sincerely hope makes it to press. -------------------- "I am not big enough to love things the way I do!"

He seems to believe that everyone has turned from him - Rowling, the fans, the fansites, etc., all because Jo is trying to stop him publishing a book that he seems to think he has the right to publish. Now, I happen to believe he's wrong on that last point, but I still feel sympathy towards him. To believe that everyone has turned from you and your reputation has been ruined because your actions are being unfairly painted would be a really terrible spot to be in. eta: Looking forward to the New Yorker article. elizabeth, you are a person of great sympathy, then, and it speaks very well of you. None of us wants anyone harmed, that's not the point. It's just an opinion thing, then, I guess. I have no doubt many will disagree with John in this episode - this area of the Lounge is not exactly known, of late, as being a one-opinion-board.
