Time for a new thread!

It's been great that by and large everyone's been respectful and thoughtful when posting. We'd like to take this opportunity to remind everyone to avoid attacking your fellow posters here, but rather to attack the argument and discuss the case and things related to it.

Hey, I went to Justia and pulled the feed info for the case, and made a widget. It's at this link for anybody who wants to pick one up (scroll down the page and just hit the "copy me" button on the widget: it'll give you code.)

For those who want to add the feed to their own feedreaders, just copy this link and paste it in wherever your reader wants it.
One word of warning though. I have been watching the rss feed for a while now, and it is prone to stray entries from at least one other case. I don't think they have ironed out all the bugs in their generation mechanism.

I noticed that. Very peculiar.

Well, Roger Rapoport will probably be speaking in the next half hour at the 'free' fund-raiser screening of Michael Moore's new doc at the Harbor Theater is Muskegon. I hope someone on this forum was able to attend. It seems like the sort of venue where Roger might make an announcement. Or at least provide us with a few quotable quotes.

Did anyone manage to get to this event? Just curious. Or have there been any media reports or similar?

From The Detroit Legal News (dated Sept. 26, 2008)
QUOTE
Vander Ark, who is in England working on a travel guide also related to Harry Potter, speaks reasonably about the disappointing decision.

"It's always been a legal question, even though there's a lot of emotional junk attached to it," he said. "And in fact the reason there's so much interest is that this has been a gray area -- a lot of the motivation right now is to clarify that. There's a personal aspect for me and Roger, too, but the question is one of where to draw the line."

Vander Ark, who spent weeks meeting with members of the Rowling team to see if something could be worked out, said he is not sure whether he would want to revise the work according to the many directions given in the judge's order that would render it non-actionable.

"I've never been against adjusting to meet their needs," he said, but is not sure whether revision would be the best use of his time.
On the Lexicon website:
QUOTE
The judge's order had nothing to do with the Web site, since that was never part of the case -- the site was the subject of high praise in the past by Rowling. According to Hasse, there is nothing in the statute which prevented the Rowling team from seeking an injunction against the site. In Hasse's opinion, "they must just have a different attitude internally about the effect of the Web site versus the book."
From David Hammer on the court's decision:
QUOTE
The New York lawyer who handled the case directly, David Hammer, said on Sept. 10, "We've been knocked down and we have to figure out, are we going to get back up and fight?"
From Harvard:
QUOTE
David Ardia of the Berkman Center at Harvard Law School, which also assists creative people with fair use defenses, commented after the decision, "The judge's interpretation of the four fair use factors was made to seem more objective than it really is. The Rowling legal team's description referred to the Lexicon as being not as transformative as similar works, not as erudite, and that seemed to color the judge's analysis on the purpose and character of the book's use. Whether a work is transformative or not is one of the most important measures of fair use."

Well, one might think that Roger Rapoport would report on the fundraiser. But the Friday entry on his blog is all about racism in Muskegon, the contribution of African-Americans to US history, and his fear that Obama will lose because he's black.

I begin to think Roger isn't happy unless he's involved in a crusade against some kind of injustice. The Lexicon lawsuit allowed him to make noise about the First Amendment. Now the election permits him to rant about the KKK and Civil Rights.

I don't know much about Michigan or Muskegon, but it seems to me Roger is playing the race card without proffering any evidence of these "KKK signs". I have no doubt racism exists, but Obama has been trying to keep race out of the campaign.

I can see Rev Jeremiah Wright and Roger Rapoport having dinner and exchanging diatribes of the "David vs Voldemort" kind. Two old men making one last grab at the brass ring and hoping to steal a little of someone else's limelight.

I did not find any reference to the fundraiser at the Muskegon Chronicle or at The Right to Write. Unless there is something to contradict me, I suspect it was poorly attended and nothing of importance was said. I suspect Roger has moved on to presidential politics and protecting the First Amendment rights of other artists and writers.

I don't think Roger liked the post-trial copy that the media printed; Judge Patterson's decision killed Roger's cause with kindness. Besides, why tilt at windmills when Dulcinea thinks Quixote misled and lied to her?
