One word of warning though. I have been watching the rss feed for a while now, and it is prone to stray entries from at least one other case. I don't think they have ironed out all the bugs in their generation mechanism.

Vander Ark, who is in England working on a travel guide also related to Harry Potter, speaks reasonably about the disappointing decision.

"It's always been a legal question, even though there's a lot of emotional junk attached to it," he said. "And in fact the reason there's so much interest is that this has been a gray area -- a lot of the motivation right now is to clarify that. There's a personal aspect for me and Roger, too, but the question is one of where to draw the line."

Vander Ark, who spent weeks meeting with members of the Rowling team to see if something could be worked out, said he is not sure whether he would want to revise the work according to the many directions given in the judge's order that would render it non-actionable.

"I've never been against adjusting to meet their needs," he said, but is not sure whether revision would be the best use of his time.

The judge's order had nothing to do with the Web site, since that was never part of the case -- the site was the subject of high praise in the past by Rowling. According to Hasse, there is nothing in the statute which prevented the Rowling team from seeking an injunction against the site. In Hasse's opinion, "they must just have a different attitude internally about the effect of the Web site versus the book."

The New York lawyer who handled the case directly, David Hammer, said on Sept. 10, "We've been knocked down and we have to figure out, are we going to get back up and fight?"

David Ardia of the Berkman Center at Harvard Law School, which also assists creative people with fair use defenses, commented after the decision, "The judge's interpretation of the four fair use factors was made to seem more objective than it really is. The Rowling legal team's description referred to the Lexicon as being not as transformative as similar works, not as erudite, and that seemed to color the judge's analysis on the purpose and character of the book's use. Whether a work is transformative or not is one of the most important measures of fair use."
